Our firm’s bankruptcy practice focuses primarily on helping our clients obtain the debt relief they need to regain control of their finances. We represent individuals and married couples in Chapter 7 and Chapter 13 cases in consumer bankruptcy cases. Our experienced attorneys, Ron Kaniuk and Molly Kindness, analyze each client’s particular financial situation and provide thorough, understandable advice. Most people who file for bankruptcy file under either Chapter 7 or Chapter 13:

Chapter 7 bankruptcy: Chapter 7 can be a good option for people who have large amounts of unsecured debt, such as credit card debts or medical bills. Those who qualify for Chapter 7 can discharge their debts without any further obligation to creditors. The entire process can be completed in as little as five months. 

Chapter 13 bankruptcy: Also referred to as a “wage-earner” plan, Chapter 13 allows you to repay your debts according to a court-approved repayment plan over a three- to five-year period. Under Chapter 13, you would make one payment to your trustee who would be responsible for distributing the funds to your creditors. Most Chapter 13 debtors can eliminate much or all of their unsecured debts, such as credit cards and medical bills. Chapter 13 is often used to save a home from foreclosure or manage tax debts.
